Advantages of a P Visa

P visa holders are eligible to work in the United States for the sponsor of the visa. The visa can be issued fairly quickly for the time needed to complete an event or season. Generally, the visa is good for up to one year. In some cases, P-1 athletes may be granted a visa for five years with the option of extending the time for up to an additional five years.

Who Qualifies for a P Visa?

This type of visa is available to athletes or teams that are recognized as outstanding in the sport. The applicant must show that they have a contract with a major U.S. sports team, league, or international sporting event. Spouses and children of the athlete may also be granted visas to accompany the player to the United States, but may not be employed during their stay in the U.S.

In order to qualify for this type of visa, the athlete must provide two forms of proof, such as:

  • Previous significant participation with a major sports league in the United States
  • Evidence that the player or team is internationally ranked
  • Statement from a professional in a sports league or governing body of the sport, which explains how the athlete is internationally recognized
  • Statement from the sports media or an expert in the field about the recognition of the athlete
  • Participation with a national team in an international competition
  • Significant participation with a U.S. college in a competition
  • Proof that the athlete or team has been awarded a significant honor in the sport

As athletic careers grow longer, athletes may spend many years on the United States. However, with a P visa, the athlete would be required to leave the country in the event of an injury or retirement. In the meantime, the athlete may have purchased a home, had children, and established roots in the United States. Planning ahead while the athlete is still actively playing may allow the player to begin the process of requesting Permanent Residence.
